Victims' counsel to file cases against CBI in Moninder Singh Pandher shoddy probe in Rimpa Halder murder case

The damning verdict in the
Rimpa Halder murder case, one of the many cases in the Nithari serial killings, notwithstanding the counsel for one of the victims of the brutal killings is contemplating to file criminal complaints against
CBI officials involved in the investigation.
While sentencing convicts
Moninder Singh Pandher and
Surinder Koli for the murder of
Rimpa Halder, the special
CBI court had pulled up the agency for shoddy probe into the serial killings.
BPS Dhakrey, counsel for Bandana Sarkar, widow of Jatin Sarkar - a key witness in the
Nithari murder case - is planning to file fresh complaints against
CBI Superintendent of Police SJM Geelani, the agency's Investigating Officer (IO) MS Fartiyal and Noida police Circle Officer Dinesh Yadav.
"We are going to file an FIR against these officers for fudging records and indulging in criminal conspiracy to save the accused. The verdict in
Rimpa Halder murder case has made it clear that the agency tried to mislead the court by providing wrong evidences to save
Moninder Singh Pandher," said Dhakrey.
It would be pertinent to note here that former
CBI director Vijay Shankar is a co-accused in the murder of Jatin Sarkar.
Khalid Khan, who represented
Rimpa Halder murder case, said that the complaint is being prepared and it would be presented before the court "very soon".
"These officers knowingly fudged records with intention to save the accused from punishment. While Geelani approved the wrong charge sheet prepared by Fartiyal it was Dinesh Yadav who agreed to prepare false evidence memos in back dates," said Khan.
The complaint would be filed under sections 217, 218 off Criminal Procedure Code (CrPC) which largely includes framing incorrect records by a public servant to save an accused. The other sections include 201- distortion of evidence, 120 (B) criminal conspiracy and 34- common intention.
"Some major misappropriations in the case include the recovery of the saw which was used to cut the bodies of the victims. Though the saw was recovered on the insistence of both Pandher and Koli the
CBI did not mention the former in its report. The investigating agency did not even present the saw before the court," said Khan.
"
Nithari murder case has completely shaken the faith of the society in the country's top investigating agency. It is not clear as why these officers tried to save
Moninder Singh Pandher but they must be punished and an enquiry should be ordered to probe their roles and intentions," said Dhakrey.
