'No bars please, we are a housing society'

In order to curtail the growing menace of mushrooming bars, restaurants and nursing homes in building societies, members of 85 societies have petitioned the CM to curb the nuisance You would think that the presence of a nursing home or a restaurant in your building may be considered a boon, but for some cooperative societies in the city, the presence of such establishments is a bane. Taking a collective stance, members of 85 cooperative societies from the city, including Thane and Navi Mumbai, have signed a petition in order to curb the daily nuisance caused by restaurants, nursing homes and pubs in their vicinity. Bar fight: Earlier MiD-DAY had reported how residents of suburban Bandra were embroiled in a tiff with owners of pubs in the area that were creating a daily ruckus and hassle to the residents. File picAggrieved members of cooperative societies, in their petition, are requesting CM Prithviraj Chavan and Cooperatives Minister Harshavardhan Patil to protect the legitimate interests of flat owners by tightening the screws on corrupt managing committee members of cooperative housing societies, and also on builders who collaborate with them. Meenal Rege, a Prabhadevi resident and also a petitioner, informed that the petition demands five points (see box) from the CM, one of which is a ban on nursing homes, pathology labs, liquor shops, restaurants, bars and party halls in housing societies. Majority of disputes and difficulties arise when the builder sells the last remaining flats on the ground floor and first floor to nursing homes and restaurants, which causes inconvenience in the form of noise pollution and traffic snarls, said Rege.u00a0 Earlier, MiD-DAY, had reported ('Bandra clubbed' July 19, 2010) how residents of suburban Bandra were embroiled in a tiff with owners of pubs in the area that were creating a daily ruckus and hassle to the residents. Keeping in mind the similar issues, the petition has made an appeal to the CM to immediately discontinue these provisions that allow the functioning of bars and other pestering enterprises in a cooperative society. Echoing sentiments of similar displeasure, another resident from Marine Drive, Pearl Goswami said, Ours is a residential building, but above our flat is a clinic. We are distressed the entire day seeing constant movement of patients. It creates lot of noise in our building and adds to our woes. Tighten the screwsThe signed petition that the societies from Marine Drive, Bandra, Dadar, Vile Parle, Andheri, Dahisar, Vasai, Chembur, Wadala, Thane and Koparkhairane (Navi Mumbai) are demanding are as follows: >> Automatic conveyance, not just 'Deemed Conveyance'. After the builder sells most of the flats in a building, and cooperative society has been formed, he should have no further claim on the plot of land or the building structure.>> Ban on nursing homes, pathology labs, liquor shops, restaurants, bars, party halls etc. in housing societies.>> Ban multiple societies within a single estate as it creates confusion and quarrels about the shared land and facilities.>> Compulsory videographing of all AGMs and a copy to be given to each member on a CD that will help prevent bullying, intimidation and non-observance of rules and democratic norms by powerful managing committee members.>> Making it compulsory to give open inspection of society documents every 6 months to all residents and rental tenants.
